TYPES OF CLAIMS
The most common type of claim heard in the Small Claims Court are debts up to $35,000. A liquidated claim is a sum of money owed is specified under an agreement and does not require any valuation by the court.
Examples of liquidated damages include:
- Monies owed for goods supplied or services rendered
- Unpaid loans
- Unpaid rent
- NSF or dishonored cheques
The Small Claims Court will also hear damage claims and assess unliquidated claims. Damage claims are those for loss, injury or deterioration caused by the negligence, design or accident of one person to another. Unliquidated damage claims are not fixed or specified, therefore these claims must be put before the court to determine the amount a plaintiff is entitled to receive.
Examples of unliquidated damages include:
- Property damage
- Personal injury
- Improper repairs
- Breach of contract
